1. Acceptance of terms
By accessing yark.pk or engaging Yark for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Services
Yark provides digital agency services including AI automation, AI marketing, web and app development, custom AI assistants, and AI integrations. Specific scope, timeline, pricing, and deliverables are defined in a separate Statement of Work or written agreement for each engagement.
3. Payment terms
Unless agreed otherwise in writing, projects require a deposit to commence and milestone payments through the engagement. Invoices are due within 14 days of issue. Late payment may pause delivery.
4. Intellectual property
On full payment, the client owns the final deliverables we produce for them. Yark retains rights to any internal tooling, frameworks, templates, and methodologies used to produce those deliverables. Yark may showcase the work in our portfolio unless the client requests otherwise in writing.
5. Confidentiality
Both parties agree to keep confidential any non-public information shared during an engagement. This obligation survives the end of the engagement.
6. Warranties and disclaimers
We will perform our services with reasonable skill and care. To the maximum extent permitted by law, all other warranties — express or implied — are excluded. Our website is provided "as is" without warranty of any kind.
7. Limitation of liability
To the maximum extent permitted by law, Yark's total aggregate liability arising out of any engagement is limited to the fees paid by the client for that engagement in the preceding three months. We are not liable for indirect, incidental, or consequential damages.
8. Termination
Either party may terminate an engagement for material breach if the breach is not cured within 14 days of written notice. On termination, the client pays for work completed up to that date.
9. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes will be resolved in the courts of Karachi, Pakistan. YARK (SMC-PRIVATE) LIMITED is registered at House No. 46/1, Sheet 11, Model Colony, Malir, Karachi East, Karachi East.
10. Changes to these terms
We may update these Terms from time to time. The current version is always posted at yark.pk/terms. Continued use of our website or services after changes means you accept the updated Terms.
